"A New Name Written Down in Glory" by C. Austin Miles appears in a hymnal published in 1910. 1938 is most likely the year that the copyrighte was renewed (28 years after the first publication). Even if the copyright was renewed, if the hymn was first published before 1927, it is public domain.

I've been wandering in the realm of publications for many years....and have come to understand that (1) public domain is not mentioned in U.S. copyright law, and (2) if any work (book, hymn, whatever) was published before 1923, it is in the public domain.

A work published in the U.S. before 1977 has copyright protection for 95 years after publication. After 95 years it no longer has copyright protections.
